Legal preparation for pharmaceutical manufacturers, marketing companies and overseas advisers responding to the new EU extended producer responsibility (EPR) system for micropollutants in urban wastewater. It is a producer-financed water-treatment regime, not the existing system for pharmaceutical packaging and not a universal collection scheme for unused medicines.
What Directive (EU) 2024/3019 actually requires
Article 9 of Directive (EU) 2024/3019 applies to producers placing products in Annex III on the market: medicinal products for human use within Directive 2001/83/EC and cosmetic products within Regulation (EC) No 1223/2009. Member States are required to establish measures by 31 December 2028 to make relevant producers bear at least 80% of the costs specified for quaternary treatment and micropollutant monitoring, alongside associated data and implementation costs.
Member States must transpose the relevant provisions by 31 July 2027. The future producer responsibilities, calculation methodology and national administrative arrangements must be examined against the final Italian implementing rules. These future dates must not be described as an EPR levy already collectable under a published Italian pharmaceutical scheme.
Producer qualification, quantities and possible exemptions
An assessment must first identify the corporate entities placing relevant medicinal products on the Union market, including whether they operate through distributors or subsidiaries. The directive addresses producer responsibility regardless of whether production takes place inside or outside the Union.
Article 9(2) provides exemptions that a producer must be able to demonstrate, including less than one tonne per year of the substances contained in products placed on the Union market, or substances that rapidly biodegrade in wastewater or do not generate micropollutants at the end of product life. These tests concern the wording and evidence required by the directive: a business should not assume that selling fewer than one tonne of finished medicine establishes exemption.
Financial exposure and information duties
The scheme envisages collective compliance through producer responsibility organisations subject to requirements under Article 10. Producer information includes annual quantities of relevant substances placed on the market, their hazardousness in urban wastewater and biodegradability, together with identified exemptions. Contributions are linked to quantities and hazardousness.
Legal advice can address the allocation of reporting and financing duties within a pharmaceutical group, responsibility between market operators, arrangements with collective organisations and the legal characterisation of cost calculations or administrative measures. Chemical measurement, toxicology and biodegradability testing must be performed by qualified technical specialists.
Implications for cross-border pharmaceutical businesses
A group headquartered outside Italy may need one coordinated compliance strategy but a separate assessment of Italian implementation. The legal work should examine what data can be obtained from the manufacturer or marketing business, what is needed from affiliates, how agreements allocate responsibility and which questions need a determination from Italian authorities or the collective organisation.
Possible deliverables include a legal applicability and exemptions memorandum, an implementation timetable, a review of data-governance and cost-allocation clauses, or a targeted opinion on a contribution assessment or administrative dispute. This service is complementary to advice on packaging EPR and pharmaceutical regulation, not a replacement for them.
Instructing Italian environmental counsel
For a preliminary scoping discussion, describe the product group, position of the manufacturer and marketing entities, jurisdictions of sale, available substance data and the issue to be analysed. Sensitive formulae, technical dossiers and commercially confidential documents should be exchanged only after conflict checks and suitable channels are agreed.
