Italian legal support for pharmaceutical manufacturers, marketing authorisation holders, contract packers, distributors and cross-border advisers addressing packaging waste obligations and Regulation (EU) 2025/40 (PPWR). The commercial objective is to identify the responsible operator and applicable requirements without compromising medicinal-product safety or confusing packaging EPR with the separate wastewater-micropollutant regime.
Pharmaceutical packaging is not a single legal category
An examination should distinguish immediate packaging in contact with the medicine, outer packaging, shipping and distribution packaging, and any specific protective or temperature-control packaging. EU medicinal-product rules impose product integrity, information and safety requirements; packaging and waste obligations must be construed alongside them.
PPWR has applied from 12 August 2026, although individual requirements have their own application dates and transition provisions. The regulation provides targeted derogations for certain medicinal-product packaging in specific provisions. These are not a general exemption from every packaging obligation, from every Italian producer-responsibility requirement or from all future PPWR provisions.
Italian producer responsibility and CONAI
For products and packaging placed on the Italian market, Legislative Decree No 152/2006 provides the national framework for packaging management and producer responsibilities, with CONAI and sectoral consortia playing defined roles. The qualification of a manufacturer, importer, distributor, contract packer or foreign online operator must be assessed in the actual transaction and distribution model.
The legal review may consider registration and contribution obligations, duties under packaging agreements, interpretation of a consortium position and allocation of data and costs within a cross-border supply chain. Routine reporting, recycling calculations and technical conformity testing require the appropriate compliance or technical professionals.
How PPWR interacts with medicinal-product rules
A packaging change driven by recyclability, minimisation or the use of specific materials may interact with the medicine’s stability, approved product information, safety or logistics. The first step is therefore to identify the specific PPWR requirement, its application date and any applicable derogation before assessing whether a change is required and who bears the legal responsibility.
A legal opinion should separate requirements applicable now from measures applicable later. The European Commission published guidance in June 2026 (C/2026/3084) on the interpretation of selected PPWR provisions; it must be read together with the binding regulation and the specific pharmaceutical framework.
Typical instructions from life-sciences law firms
Market-entry review. Identify relevant Italian packaging-EPR obligations for a foreign pharmaceutical business, importer or packaging contractor, and map the responsible economic operators.
Contract review. Consider distribution, toll-manufacturing, packaging and logistics terms allocating regulatory information, liabilities and contribution costs.
Targeted controversy. Analyse a disputed packaging classification, contribution request, inspection finding or administrative measure under Italian law, with technical input where required.
A useful initial enquiry
Provide the medicinal product category, packaging layers, role of each operator, Italian sales and import arrangements, the PPWR question and any deadline. Do not send confidential formulations or sensitive contractual schedules before engagement checks.
