Italian legal and medico-legal practice

Independent Medico-Legal Expert Referrals in Italy | Lawyers & Insurers

For overseas law firms, insurance defence teams and claims professionals who need an independent medico-legal opinion on an Italian matter. Dr Valeria Liguori’s technical assessment is a distinct medical professional appointment: it is neither a legal opinion nor an exclusive IR Global practice area.

Which technical questions can be instructed?

  • A disputed injury mechanism, chronology or compatibility between reported events and medical findings.
  • Medical causation in a healthcare-liability dispute, with analysis of the clinical record and identified departures or uncertainties.
  • Temporary and permanent impairment, documented functional consequences, pre-existing conditions and clinical prognosis.
  • A focused review of radiology reports or original imaging with specialist input where necessary.
  • Critical examination of an existing medical report, party expert assessment (CTP) or court-appointed expert report (CTU), within applicable procedural rules.

Independent scope, evidence and limits

The referring professional identifies the clinical question and the use intended for the report; the medical expert determines the approach, evidence needed and professional conclusions. Depending on circumstances, a file-based review, in-person examination, original radiological material or additional specialty opinion may be necessary. The report should clearly distinguish contemporaneous records, later allegations, hypotheses and the limits of retrospective dating.

How a foreign adviser can instruct

  • Start with a non-identifying factual outline, type of accident or medical treatment, relevant dates, Italian jurisdiction and required deadline.
  • Describe the technical issue: causation, impairment, contradictory imaging, severity of injury or critique of an existing report.
  • Await a conflict and professional-capacity assessment and agreement on the deliverable, fees, language and reporting timetable.
  • Use a secure exchange channel and an appropriate lawful basis before transferring identifiable health information.
  • Receive the independent written opinion or agreed technical review, with its evidential limitations expressly recorded.

Separate legal representation when required

The legal assessment of liability, limitation periods, procedure, applicable insurance policy and court representation belongs to qualified lawyers. Where an overseas counsel also needs advice on Italian law, a separate mandate may be considered with Alfonso Maria Fimiani; the doctor and lawyer maintain distinct responsibilities and conflicts checks.

Use within IR Global and other professional networks

Referrals from IR Global members can follow the network’s principles of transparent introductions, a complimentary preliminary discussion on request and respect for the referring firm’s client relationship. These protocols do not turn the independent medical report into a network-certified conclusion or guarantee a particular result. The medico-legal competence is complementary to the Studio’s Environmental Law membership, which officially begins on 28 November 2026.
