Italian legal assistance and independent medico-legal evaluations for disputes involving healthcare liability, accidents and personal injuries.

Two complementary but distinct professional functions
A compensation claim arising from medical treatment or an accident may require both an analysis of Italian civil liability law and an assessment of the medical evidence. Legal counsel and medico-legal consultants perform separate roles, even where coordination of their work is useful.

Legal assessment
The lawyer examines the possible basis of liability, applicable limitation periods, procedural requirements and potential remedies, together with the evidentiary requirements of the particular claim. Outcomes cannot be assessed responsibly without the relevant facts and documents.

Medico-legal assessment
The medical expert examines the clinical record, possible causal links, the nature and evolution of injuries, functional impairment and relevant medico-legal parameters. Each finding must be supported by the available documentation and appropriate medical methodology.

Overseas claimants and referring professionals
We can receive enquiries involving treatment or injury in Italy from individuals, insurers and foreign law firms. The precise scope of legal or technical services is agreed separately with the responsible professionals.
Independent medico-legal expertise →
Cross-border instructions in medical liability and serious injury
For foreign claims teams. A medical event or accident in Italy can require a preliminary Italian-law assessment before proceedings are commenced. We examine jurisdictionally relevant facts, limitation issues, potential defendants, available documents and the appropriate sequence of evidentiary steps under Italian procedure, as applicable.
Independent medico-legal evidence. Where medical causation or quantification is disputed, a separately instructed medico-legal expert may review clinical records, the alleged injury and residual impairment. The legal conclusion remains the responsibility of the lawyer; technical findings do not predetermine liability.
Mandate and documents. Overseas counsel or insurers should specify the Italian connection, incident date, procedural stage, relevant notification deadlines and technical questions. Instructing a medico-legal expert is distinct from retaining Italian counsel. Independent medico-legal expertise · Initial enquiry.
This service is also available in French: Responsabilité médicale en Italie and Italian: Responsabilità sanitaria.
