A Chinese manufacturer supplying an independent Italian importer and a Chinese brand selling directly to Italian consumers may have different obligations under Italian extended producer responsibility (EPR) rules. The legal analysis concerns the relevant product category, the actual distribution structure and the identity of the operator responsible under the applicable Italian regime.

Who bears EPR obligations when products are manufactured in China?
A factory supplying an independent Italian importer, a Chinese brand selling directly to Italian customers, an EU subsidiary and a marketplace seller can face different duties. The contractual chain, brand ownership, place of establishment, first supply and distribution channel must be examined separately. Legal advice starts by identifying the relevant economic operator rather than assuming that every Chinese factory must register directly.
Products and regulatory schemes to check
Electrical and electronic equipment (WEEE / RAEE): determine whether the product falls within the rules, who qualifies as producer and which Italian registration and representation obligations apply. A non-EU distance seller may face different requirements from a supplier selling solely to an Italian importer. Explore WEEE law in Italy.
Batteries and battery-powered products: Regulation (EU) 2023/1542 addresses portable, industrial, vehicle and other battery categories, including batteries contained in products. Distance sales from third countries require careful consideration of the producer definition and EPR representative rules. Explore battery EPR.
Packaging and packaged goods: Italian producer-responsibility arrangements and Regulation (EU) 2025/40 (PPWR), applicable from 12 August 2026 with differing transition dates for certain provisions, must be assessed according to the commercial chain and packaging role. Explore packaging and PPWR.
Textiles, fashion, tyres and other product streams: sector-specific national and EU rules may be relevant. Emerging systems must be distinguished from regimes already applicable in Italy; no future registration obligation should be described as if it were already operational. Textile EPR · Tyres.
What we can deliver
Our Italian-law mandate may consist of (i) a producer-status and applicability opinion, (ii) a product-by-product EPR compliance map for Italy, (iii) review of Italian importer, distributor and marketplace contracts, (iv) analysis of registration or authorised-representative requirements where applicable, or (v) assistance on notices, inspections, administrative measures and disputes. Regulatory filing, product certification, laboratory testing and operational waste collection are separate activities that may require other specialists.

For Chinese businesses and their foreign advisers
We can receive instructions directly from an overseas business or from Chinese lawyers, accountants and compliance consultants seeking Italian local counsel for a defined workstream. The overseas adviser may retain the lead-client relationship. Scope, conflicts, fees, deadlines and communication arrangements are agreed before a mandate is accepted; we do not claim that our staff provide fluent Chinese-language legal consultations.
