A refusal, restriction, exclusion or enforcement measure adopted by an Italian public authority may affect a business operation or individual right. The available administrative and judicial remedies depend on the legal nature of the act, the competent authority and the applicable time limits.
Identify the act and relevant deadline
The date and method of notification, the full decision, the underlying procedure and any access-to-documents requests are central. Administrative appeals may involve short mandatory deadlines, and the correct remedy depends on the type of act.
Business, permits and procurement
Environmental permits, industrial activities, public concessions, procurement exclusions and regulatory restrictions can each give rise to distinct procedural routes. We assess the documents, the client’s legal interest and potential interim protection.
When an individual is affected
A building or planning decision, an administrative refusal or another act addressed to a person may require examination of the competent administration and applicable jurisdiction. Not every disagreement with a public body belongs before the TAR.
Cross-border instructions
Foreign companies and advisers can request a targeted opinion or Italian procedural representation. Send the decision, notification date, relevant correspondence and a non-confidential outline of the desired outcome.

Challenging an Italian administrative decision: the first question is which act and when it was notified
A foreign company receiving a refusal of an industrial permit, a restrictive order or an adverse public-procurement decision should preserve the complete act, its enclosures, the notification evidence and the underlying technical file. Under Italian Law 241/1990, administrative participation and access to documents may be relevant; the Code of Administrative Procedure (Legislative Decree 104/2010) governs litigation before the administrative courts where jurisdiction is established. A mere commercial disagreement with a public entity does not automatically fall within TAR jurisdiction.
The legal assessment must identify the issuing authority, the measure’s immediate effects, available administrative remedies, the specific deadline for challenge, any urgent interim protection and the evidence required. In environmental matters, technical findings, permit conditions and regional or sector-specific procedures may alter the approach. A foreign referring lawyer should receive a defined Italian-law procedural opinion rather than a generic promise to appeal.

Italian public procurement: admission to the tender and challenging an award are separate matters
A foreign contractor seeking access to an Italian public tender should first review the tender notice and contract documents, the eligibility and qualification conditions, electronic-submission rules, exclusion grounds and the precise status of the economic operator under EU and Italian law. Legislative Decree 36/2023 is the core Italian public-contracts framework, as amended. Eligibility for non-EU operators cannot be presumed identical to that of EU-established businesses; applicable international commitments and the concrete tender conditions require examination.
If the authority excludes a bidder or awards the contract to another operator, the legal response depends on the decision, its availability and notification, access to the procurement file and the particular deadlines. The merits of the tender criteria and technical evaluation may require independent specialists. Procurement challenges follow specialised administrative procedures: a general statement about ordinary TAR time limits is not a substitute for a case-specific review.
